Releasing a company, leased or financed vehicle

The person using the vehicle may not be its legal owner or registered keeper. Establish each role before arranging insurance or sending somebody to the pound.

Write down who is who

Identify the legal owner, registered keeper, employer or leasing customer, driver at seizure, proposed collector and insurance policyholder. Use the names shown on the agreements rather than the everyday description “my company car”.

A limited company is a separate legal person. A director or employee may need written authority even when they normally drive the vehicle.

Contact the owner or fleet manager

Tell the leasing company, finance provider or fleet department promptly. It may have its own recovery procedure, insurance arrangements and approved transporters. Some agreements restrict who may collect or where the vehicle may be taken.

Ask for the authority document and ownership evidence the pound requires. Do not cancel or replace fleet insurance without the responsible organisation’s agreement.

Prepare business documents

Useful evidence may include the V5C, lease or hire agreement, finance schedule, company letter, employee identification and proof that the signatory can act for the business. The pound decides which originals or electronic documents are acceptable.

The authority letter should identify the vehicle, authorised person and purpose. Generic headed paper with no registration or date may not be enough.

Arrange insurance for the real use

Tell the insurer who owns and keeps the vehicle, how it is used and who will drive after release. Business, delivery, courier or hire use should not be described as ordinary commuting. The certificate must also deal with impound release where the pound requires it.

A director’s personal policy or a colleague’s driving-other-cars extension may not fit company ownership. Ask before relying on either.

Before the appointment

Confirm:

  • the owner has approved release;
  • the attendee has company authority;
  • the V5C or agreement connects the business to the vehicle;
  • the driver and business use are insured;
  • the pound accepts the document format;
  • payment and destination have been authorised.

Keep the employer, owner and insurer reachable during the appointment. If the contract is in dispute or finance has been terminated, obtain advice before presenting yourself as the owner.

Different arrangements need different authority

The paperwork will depend on the vehicle relationship:

  • company-owned pool vehicle;
  • employee company car;
  • personal contract purchase;
  • hire purchase or conditional sale;
  • short-term rental;
  • long-term lease or salary sacrifice.

For a hire or lease vehicle, the registered keeper may be the rental or leasing company. Its agreement may require immediate notice of seizure and prohibit the customer from arranging disposal. Ask whether it will reclaim the vehicle itself or authorise you to act.

With finance, legal title may remain with the lender until the agreement ends. The customer can still be the registered keeper and usual driver, but should not describe themselves as outright owner if asked. Give the insurer and pound the correct division between keeper, owner and policyholder.

If an employee caused the seizure outside authorised use, the employer may investigate separately. That does not remove the need to meet release deadlines. Keep employment discussions, police allegations and pound documents organised so that a delay in one process does not hide another response date.

Before paying personally, establish whether the business, fleet insurer, leasing company or driver is responsible under their agreement. The pound may require immediate payment regardless of that private allocation. Obtain an itemised receipt so reimbursement can be discussed later with evidence.

Rental vehicles need particularly quick contact with the hire company. Its insurer, roadside provider and contract terms may dictate the collection. Continuing daily hire charges can be separate from pound storage. Do not nominate another driver or extend the hire without permission. Record who at the rental business authorised each step and give the pound the company contact it requests. If business equipment remains inside, arrange access through the same authority process rather than treating an employee pass as proof of ownership. Keep written confirmation of who is collecting and where the vehicle must be delivered afterwards.
